TERMS AND CONDITIONS
For Elevated Escapes (Agency/Company)
1. Scope of Services
The Company acts solely as a booking agent for third-party suppliers (e.g., airlines, hotels, tour operators, cruise lines). The Company does not own or operate these services and is not the direct provider of travel.
2. Booking and Payments

Booking Accuracy: Clients must immediately verify all details (legal names, dates, airports) upon receiving a confirmation. The Client assumes full responsibility for costs arising from unreported errors.

Pricing: Quoted prices are subject to change due to currency fluctuations, fuel surcharges, or supplier price increases until the booking is confirmed and paid in full.

Payment Terms: A non-refundable deposit is typically required to secure a booking. Final payment deadlines are set by the individual suppliers; failure to meet these may result in automatic cancellation.
3. Cancellations and Refunds

Supplier Policies: All bookings are subject to the specific cancellation and refund policies of the respective suppliers (airlines, hotels, etc.). Some bookings may be 100% non-refundable from the time of deposit.

Agency Fees: The Company may charge a separate, non-refundable service or planning fee (e.g., $100–$250) for research, customization, or processing cancellations.

Refund Tiers: Typical industry structures for package tours include, but not limited to:

60+ days before departure: Full refund minus deposit.

30–59 days before departure: 50% refund.

Less than 30 days: No refund

4. Travel Documentation and Requirements

Passports/Visas: It is the Client’s sole responsibility to ensure they possess a valid passport (often requiring 6 months' validity beyond the return date) and all necessary visas or entry permits.

Health and Vaccinations: Clients must verify and comply with all health requirements, including vaccinations and COVID-19 protocols, for their destination.

Criminal Records: Some countries may deny entry based on past criminal offenses. Clients are responsible for checking these restrictions directly with the destination country.
5. Travel Insurance

Recommendation: The Company strongly recommends that all clients purchase comprehensive travel insurance. This should cover trip cancellation, medical emergencies, evacuation, and loss of luggage.

Waiver: If a client chooses to decline insurance, they acknowledge they are personally responsible for all financial losses resulting from unforeseen events.
6. Limitation of Liability

Supplier Acts: The Company is not liable for any injury, loss, or damage caused by the negligence or default of any third-party supplier.

Maximum Damages: The Company’s total liability for any claim shall not exceed the amount actually paid by the Client to the Company for its services.
7. Dispute Resolution

Chargebacks: Clients agree not to initiate credit card chargebacks for services rendered or for cancellations that fall under the agreed-upon supplier terms.

Jurisdiction: Any legal disputes shall be governed by the laws of the United States of America, state of California and resolved in the courts of the county of Madera.
8. Professional Planning & Service Fees
The Company charges non-refundable professional fees to compensate for the time, expertise, and resources required to research, curate, and manage your travel. These fees are separate from the cost of the travel itself.

Tier 1: Essential Trip Planning ($100)

Best for: Single-destination domestic or short-haul international trips (e.g., Mexico, Caribbean).

Includes: Researching up to 3 options, booking, and final documentation.

Tier 2: Custom International Itinerary ($250)

Best for: Multi-city tours, complex logistics, or luxury international arrangements.

Includes: Full concierge service, logistics management, and customized daily schedules.

Tier 3: Group Travel / Destination Weddings ($500+ / Custom Quote)

Best for: Managing 10+ travelers with unique requirements.

Includes: Room block management, guest communication, and specialized vendor coordination.

Revision & Late Change Fees: Any changes made to a confirmed itinerary will incur a minimum fee of $25–$75 per person depending on component, in addition to any supplier-imposed change or airline penalties.
9. Force Majeure (Unforeseeable Events)
A "Force Majeure Event" is any event beyond the reasonable control of the Company or its suppliers which makes it impossible, illegal, or inadvisable to provide the travel services.

Scope of Events: These include, but are not limited to: acts of God, fire, flood, natural disasters, explosions, war, civil unrest, terrorism, government-imposed travel bans, pandemics (including COVID-19 or similar health emergencies), strikes, or airline/supplier insolvency.

Limited Liability: In the event of a Force Majeure, the Company’s sole obligation is to assist the Client in obtaining refunds or credits from the third-party suppliers.

Refund Policy: Professional planning fees are non-refundable even in Force Majeure scenarios. Many suppliers may offer travel credits rather than cash refunds; the Company is not responsible for a supplier's refusal to issue a cash refund.

No Damages: The Company will not be liable for any additional costs, such as non-refundable airfare, alternative accommodation, or loss of enjoyment, resulting from a Force Majeure event.
10. Protection Against Chargebacks

By signing these terms, the Client agrees not to initiate a credit card chargeback for any "non-refundable" planning fees or for travel disruptions caused by Force Majeure or supplier failure. Clients acknowledge that travel insurance is the primary method for recovering financial losses in these instances.
